Terms of Service

1. Agreement to Terms

By accessing and using NervePay ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to abide by the above, please do not use this service. NervePay reserves the right to modify these terms at any time without notice.

2. Use License

Permission is granted to temporarily download one copy of the materials (information or software) on NervePay for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

• Modifying or copying the materials
• Using the materials for any commercial purpose or for any public display
• Attempting to decompile or reverse engineer any software contained on the Service
• Removing any copyright or other proprietary notations from the materials
• Transferring the materials to another person or "mirroring" the materials on any other server
• Violating any applicable laws or regulations

3. Agent Identity and Credentials

When you register an agent identity with NervePay, you receive:

• A Decentralized Identifier (DID)
• Ed25519 private and public keys
• BIP39 recovery mnemonic

You are responsible for securely storing these credentials. NervePay does not store your private keys. Loss or compromise of these credentials may result in permanent loss of access to your agent identity. You acknowledge that these credentials are shown only once and must be saved immediately.

4. Acceptable Use Policy

You agree not to use NervePay to:

• Engage in any fraudulent, deceptive, or misleading activities
• Launch attacks against NervePay infrastructure or other users
• Violate any applicable laws or regulations
• Impersonate others or create fraudulent identities
• Scrape or harvest data without authorization
• Attempt to gain unauthorized access to systems or data
• Engage in high-volume automated requests designed to overload systems
• Use the service for illegal purposes including but not limited to money laundering, fraud, or sanctions evasion

5. Payment and x402 Protocol

NervePay supports optional x402 HTTP payments via stablecoins on Base network:

• All payments are final and non-refundable unless explicitly agreed otherwise
• You are responsible for transaction fees and network costs
• We reserve the right to refuse or reverse transactions that violate these terms
• Payment agents must comply with all applicable financial regulations
• Smart wallet functionality (ERC-4337) will be available as a separate opt-in feature

6. Reputation Scores and Attestations

Reputation scores and agent attestations are provided for informational purposes only and do not constitute investment advice, endorsement, or guarantee of agent behavior. NervePay does not verify the accuracy of attestations made by third parties.

7. Disclaimer of Warranties

The materials on NervePay are provided on an "as is" basis. NervePay makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

8. Limitations of Liability

In no event shall NervePay or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on NervePay, even if NervePay or a NervePay authorized representative has been notified orally or in writing of the possibility of such damage.

9. Accuracy of Materials

The materials appearing on NervePay could include technical, typographical, or photographic errors. NervePay does not warrant that any of the materials on NervePay are accurate, complete, or current. NervePay may make changes to the materials contained on NervePay at any time without notice.

10. Links

NervePay has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by NervePay of the site. Use of any such linked website is at the user's own risk.

11. Modifications

NervePay may revise these terms of service for NervePay at any time without notice. By using this website, you are agreeing to be bound by the then current version of these terms of service.

12. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of Delaware, and you irrevocably submit to the exclusive jurisdiction of the courts in that location.
